TINUBU WILL FACE CHALLENGES IN COURT BECAUSE INEC KNOWS THE WINNER DIDN'T GET 25% IN THE FCT - BWALA SAYS



It will be challenging for Tinubu in court because INEC is aware that the winner did not receive 25% in the FCT, according to Bwala.


Bola Ahmed Tinubu's victory at the Supreme Court will be challenging, according to Daniel Bwala, the spokeswoman for the Atiku/Okowa campaign council. Over 50 attorneys had been hired by Asiwaju to represent him in court. Bwala argued that the former governor of Lagos State is under pressure because the INEC disregarded its own set of regulations.


He claimed that while Asiwaju's failure to win the FCT is probably another point of contention, failing to receive 25% in the state is a significant disadvantage for him. The attorney who also argued that Tinubu was declared the winner after the INEC Chairman interpreted the law incorrectly. According to him, the law makes it clear that the commission must fix any problems before announcing the results.    


He said, ''The process that led to the announcement of the election result was not consistent with the provisions of the electoral act. Particularly section 65 where it states that in the course of coalition, if there are issues as a result of the elections at the polling unit. That the commission within seven days should rectify the issues before the final announcement. 


The INEC Chairman was asked the question in the course of the coalition but unfortunately he misinterpreted that part of the law and even promised that after the announcement he was going to look into it in seven days which he never did anyway. And then lastly, INEC was asked before this election that if there is no clear winner, are you prepared for a rerun? He said yes and cited an example. 


The provision of section 134 of the constitution is also clear that where any of the candidates secures the majority but he does not fulfill the mandatory requirement of securing 25% in the FCT, that person cannot be declared as the winner of the election. And as we speak, INEC knows the Winner did not get 25% in the fct, so it will be tough for Tinubu in court.''
