PRESIDENTIAL ELECTION PETITION TRIBUNAL RESUMES TO TESTIMONY OF WITNESSES — ATIKU



The Presidential election petition tribunal resume sitting today to start listening to testimony of witnesses [INEC staff, Microsoft, IBM and Oracle] invited by Atiku Abubakar to prove the existence of INEC server. 

Tribunal will also commence hearing on application by the PDP seeking to set aside the proceeding of June 11 and pre-hearing.

“It will not be expedient that the court should grant prayers contained in the application,”......it would amount to “resolving the disputed issue regarding the central server and electronic transmission of results of the presidential election,” at the preliminary stage of the proceedings." 

"The scenario will be unpalatable and will create the impression that the court has indeed recognised the existence of a central server and that the result was electronically transmitted." “The law is settled that the court should ensure caution while dealing with interlocutory application so as not to make any observation that affects the substantive case.”

He said the tribunal will have to entertain testimonies of witnesses and documentary evidence from all parties before it can rule on the existence of the server.

“These are issues to be tried during the hearing, you cannot try them in piecemeal,” INEC’s lawyer told newsmen.
